Statutory Process
New Jersey Conversion Law Statutory Process (N.J.S.A. 17:48E-49 et seq.) - Commissioner of DOBI has 60 days after submission of an application of conversion to determine if said application is complete; the Attorney General has 60 days after submission of petition for review of foundation plan to determine if the foundation plan is complete.
- Public hearing(s) must be scheduled within 90 days after the application is determined to be complete (unless health service corporation requests, and commissioner agrees to, a longer period of time).
- A health service corporation must provide the public with at least 45 days' notice of public hearing(s) (first publication not more than 45 days prior to hearing; last publication not less than 15 days prior to hearing).
- Commissioner of DOBI's determination of approval or rejection of the application of conversion must be issued within 45 days after closing of the public hearing (commissioner may extend time frame, for good cause).
- The order of the Commissioner of DOBI shall not take effect unless the Superior Court has issued a subsequent order approving the establishment of the foundation.
